All rights not expressly granted to you in these Terms of Service are reserved and retained by BarPass or its licensors, suppliers, publishers, rightsholders, or other content providers. No BarPass Service, nor any part of any BarPass Service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of BarPass. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of BarPass without express written consent. BarPass reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.
There are no cancelations. All fees are NON-REFUNDABLE.

Any dispute or claim relating in any way to your use of any BarPass Service, or to any products or services sold or distributed by BarPass will be resolved by binding arbitration, rather than in court. A neutral arbitrator in Phoenix, Arizona will be selected by BarPass and all arbitration will be conducted in Phoenix, Arizona. The Federal Arbitration Act and federal arbitration law apply to this agreement. You and BarPass are jointly responsible for the costs. In addition, BarPass is permitted to seek an award of attorneys’ fees and costs in arbitration if the arbitrator determines the claims are frivolous.
By using any BarPass Service, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Arizona, without regard to principles of conflict of laws, will govern these Terms of Service and any dispute of any sort that might arise between you and BarPass.
Site Policies, Modifications, and Severability:
These Terms of Service and Privacy Notice policies govern your use of BarPass. We reserve the right to make changes to our site, policies, Terms of Service, and Privacy Notice at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
